These Terms and Conditions govern registrations for courses, certification programmes, workshops, assessments and other programmes offered by the National Association for Strength & Conditioning Research (NASC).

1. About NASC

The National Association for Strength & Conditioning Research (NASC) is a registered association in Malaysia.

Certain administrative and payment processing functions for NASC courses are managed by ZK Strength Sifoo Academy (SSM Registration No. 002946941-T) as an authorised administrator acting on behalf of NASC.

References to “NASC”, “we”, “us” or “our” in these Terms refer to NASC and, where applicable, its authorised administrator acting on its behalf.

2. Registration

Registration is considered confirmed once:

  1. the required registration information has been submitted;
  2. the required course fee or payment has been successfully received; and
  3. registration confirmation has been issued.

Participants are responsible for ensuring that all information submitted during registration is accurate and complete.

Registration is personal to the registered participant unless a transfer has been expressly approved by NASC.

3. Course Fees and Payment

The applicable course fee will be displayed or communicated before payment.

Payments may be made through payment gateways, bank transfers, DuitNow QR, e-wallets, Buy Now Pay Later services or other payment methods made available from time to time.

Payment processing for NASC courses may be administered by ZK Strength Sifoo Academy on behalf of NASC. Accordingly, the name ZK Strength Sifoo Academy may appear on certain payment gateways, bank statements or transaction records.

4. Participant Cancellation

Once registration has been confirmed, course fees are generally NON-REFUNDABLE where cancellation, withdrawal or non-attendance is initiated by the participant, except where a refund or other remedy is required under applicable Malaysian law.

Refunds will not normally be provided due to:

  • change of mind;
  • personal or family commitments;
  • work commitments;
  • scheduling conflicts;
  • transportation or travel issues;
  • inability to obtain leave or approval from an employer;
  • inability to attend;
  • failure to attend (“no-show”);
  • voluntary withdrawal; or
  • other circumstances attributable to the participant.

5. Transfer of Registration

Any request to transfer registration to another course date, location, programme or participant is subject to prior approval by NASC.

Approval is not automatic.

Any applicable administrative charges or differences in course fees may apply.

6. Course Postponement or Rescheduling

NASC reserves the right to postpone or reschedule a course where reasonably necessary due to operational requirements, trainer availability, venue issues, insufficient enrolment, safety concerns, emergencies, circumstances beyond reasonable control or other reasonable circumstances affecting course delivery.

The same registered course may be postponed or rescheduled up to two (2) times.

For the first and second postponement, the participant’s registration and course fees paid will automatically be transferred to the replacement date.

A postponement or rescheduling within these two permitted occasions does not, by itself, constitute cancellation and does not automatically entitle the participant to a refund.

7. More Than Two Postponements

If the same registered course is postponed for a third time, the affected participant may choose either to:

  1. retain the registration and attend the newly scheduled course; or
  2. request a refund of the applicable course fee paid.

8. Cancellation by NASC

If NASC cancels a registered course and does not provide a reasonable replacement or rescheduled course, affected participants will be eligible for a refund of the applicable course fee paid.

Where NASC is unable to provide the registered service due to circumstances attributable to NASC or its authorised administrator, an appropriate remedy will be provided in accordance with applicable Malaysian law.

9. Changes to Course Arrangements

NASC reserves the right to make reasonable changes to:

  • trainers or instructors;
  • training venues;
  • timetables;
  • course schedules;
  • learning materials;
  • assessment arrangements;
  • course sequencing; or
  • mode of delivery,

where reasonably necessary.

Reasonable operational changes that do not materially deprive the participant of the registered programme will not automatically constitute cancellation.

10. Attendance, Assessment and Certification

Registration, payment or attendance does not guarantee certification.

Participants must satisfy all requirements applicable to the relevant NASC programme, which may include:

  • minimum attendance requirements;
  • examinations;
  • practical assessments;
  • assignments;
  • competency requirements; and
  • other certification requirements.

Certification will only be awarded to participants who successfully satisfy the applicable requirements.

11. Participant Conduct

Participants must comply with reasonable instructions, safety requirements and standards of professional conduct.

NASC reserves the right to remove a participant for serious misconduct, abusive or threatening behaviour, cheating, fraud, deliberate disruption, damage to property or conduct that creates an unreasonable safety risk.

Removal due to participant misconduct will not normally entitle the participant to a refund.

12. Intellectual Property

All NASC course manuals, modules, presentations, assessment materials, examination materials, videos, learning resources, graphics, trademarks, logos and related materials remain the intellectual property of NASC and/or their respective rights holders.

Participants may not reproduce, distribute, sell, publish, upload, record for redistribution or commercially exploit such materials without prior written permission.

13. Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any statutory right or remedy that cannot lawfully be excluded under the Consumer Protection Act 1999 or other applicable Malaysian law.

Where any provision of these Terms conflicts with a mandatory requirement of Malaysian law, the applicable legal requirement will prevail to the extent of that inconsistency.

14. Governing Law

These Terms and Conditions are governed by the laws of Malaysia.

16. Acceptance

By completing registration and proceeding with payment, the participant confirms that they have read, understood and agreed to:

  • these Terms & Conditions;
  • the Privacy Policy; and
  • the Refunds & Dispute Policy.

The participant specifically acknowledges that participant-initiated cancellations are generally non-refundable and that NASC may postpone or reschedule a registered course up to two (2) times, subject to applicable Malaysian law.
